  • Welcome to Drive Dash AI! These Terms of Service ("Terms") govern your access to and use of the Drive Dash AI website (drivedash.ai) and the associated software, applications, and services (collectively, the "Service").

  • By registering for, accessing, or using the Service, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Drive Dash AI provides an artificial intelligence-assisted dashboard designed to help business owners manage their Google Business Profiles, surface local SEO insights, and automate customer review workflows. The Service connects to your Google accounts via secure APIs to facilitate these features.

2. Account Registration and Security

  • Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

  • Account Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

  • Security: You are responsible for safeguarding your account credentials. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use of your account.

3. Integration with Third-Party Services (Google APIs)

  • Our Service integrates closely with Google services (e.g., Google Business Profile, Google Search Console).

  • Compliance with Third-Party Terms: By linking your Google account, you agree to comply with Google's Terms of Service.

  • API Access: Drive Dash AI will only access, use, and store your Google data as explicitly authorized by you and in strict accordance with our Privacy Policy and Google’s API Services User Data Policy, including the Limited Use requirements.

  • Service Interruptions: We are not responsible for service interruptions, data inaccuracies, or feature limitations caused by changes, outages, or revocations of access by Google or any other third-party provider.

4. Acceptable Use and User Conduct

  • You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: violate applicable federal, state, local, or international laws; reverse-engineer or hack the Service; distribute spam or malicious software; post fake reviews or manipulate search rankings; or resell access.

5. Intellectual Property Rights

  • Our Property: Drive Dash AI retains all rights, titles, and interests in and to the Service, including its software, algorithms, AI prompts, designs, and branding. You are granted a limited, non-exclusive, non-transferable license to use the Service.

  • Your Property: You retain all ownership rights to the business data, content, and materials you connect to or upload into the Service. You grant Drive Dash AI a limited license to access, process, and display this data solely for the purpose of providing the Service to you.

6. Fees and Payments

  • Subscription Plans: Access to Drive Dash AI requires a paid subscription. The Service is billed at a standard rate of $59.99 per month. Alternatively, you may choose an annual subscription, which provides a 15% discount off the total annualized cost when paid in full upfront.

  • Token Overage Fees: Your subscription includes a standard allotment of AI token usage. If your account exceeds this standard allotment during a billing period, an additional overage fee of $25.00 will be automatically applied to your account to cover the expanded token use.

  • Billing and Auto-Renewal: Fees are billed in advance on a recurring basis. Contracts automatically renew unless notice of cancellation is provided at least thirty (30) days prior to the end of the term.

  • Cancellations and Refunds: You may cancel at any time, effective at the end of the billing cycle. Payments are non-refundable.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DRIVE DASH AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI-GENERATED RECOMMENDATIONS WILL RESULT IN INCREASED REVENUE OR SEO RANKINGS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DRIVE DASH AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms or failure to pay undisputed fees. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Harrisburg, Pennsylvania.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by updating the last updated date or sending you an email. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
